Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hemsy AI platform, including our AI-powered virtual try-on and style editor services, websites, applications, SDKs, and any white-labeled or embedded experiences (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Hemsy AI provides an AI-powered virtual try-on and styling experience that allows users to visualize apparel and accessories on a digital likeness using images, video, or camera input.

The Service may be offered:

  • Directly by Hemsy AI
  • Via white-labeled or co-branded experiences for third-party merchants
  • Through links embedded in online storefronts, emails, or advertisements
  • Through future consumer-facing applications

The Service is provided for visualization and inspiration purposes only and does not guarantee product fit, appearance, availability, or suitability.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

3. User Content

To use the Service, you may upload or submit images, video, or other content ("User Content").

By submitting User Content, you:

  • Represent that you own or have the necessary rights to the content
  • Grant Hemsy AI a limited, non-exclusive, royalty-free license to process and use the content solely to provide, operate, and improve the Service
  • Acknowledge that AI-generated outputs are simulated approximations

Hemsy AI does not claim ownership of your User Content.

4. AI Outputs and Limitations

The Service uses automated systems and machine learning models to generate virtual try-on and styling outputs.

You acknowledge that:

  • Outputs are generated algorithmically
  • Results may be inaccurate or incomplete
  • Outputs do not constitute guarantees of real-world appearance, fit, or performance

Use of the Service is at your own risk.

5. White-Labeled and Third-Party Experiences

When the Service is accessed via a merchant or brand, that merchant may control certain aspects of the user experience. Hemsy AI is not responsible for third-party products, pricing, fulfillment, or policies.

6. Prohibited Use

You agree not to:

  • Upload content you do not have rights to
  • Upload unlawful, harmful, or abusive content
  • Attempt to reverse engineer, scrape, or misuse the Service
  • Use the Service for impersonation, deception, or fraud

7. Intellectual Property

All software, AI models, designs, and platform components (excluding User Content) are owned by Hemsy AI or its licensors and are protected by applicable intellectual property laws.

8. Termination

Hemsy AI may suspend or terminate access to the Service at any time for any reason, including violation of these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." HEMSY AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEMSY AI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

12. Changes

We may update these Terms periodically. Continued use of the Service constitutes acceptance of the updated Terms.
